Can You Sell Your House While Your Chapter 13 is Active
Yes you can sell your house while your Chapter 13 is active but be prepared to explain in detail why you want to make this change and how it will affect your monthly budget. #chapter13 #atlantabankruptcy
Chapter 13 is a payment plan and it works best when your income and expenses are stable throughout the five year term of most Chapter 13 repayment plans.
But, life happens and sometimes it is necessary to move for a new job, because of a change in income or because you need different living arrangements.
In order to sell a home while in Chapter 13 you will need to explain the reason behind your request and present estimated changes to your budget to the trustee, and you will need to present your proposal to the bankruptcy judge. If your proposal calls for a reduction in Chapter 13 payments or a reduction in the percentage repayment to unsecured creditors you will have to service notice on your creditors and give them an opportunity to object.
Assuming the numbers work, you should be able to resolve any concerns from the #chapter13trustee and it is likely that the #bankruptcyjudge will approve your proposed sale. However, assume that the approval process may take several weeks and also assume that your attorney will ask for an increase in fees that are being paid through your Chapter 13 plan.

    Sounds like you might be better off to just stop paying your debts and let them drop off in 7 years. Especially if you live in a state where they cannot garnish your wages and you do not own a home that a lien could be placed on.

    I filed Chapter 13, should of never did it! I wish people will be honest going in I agreed to a 100% plan the trustee sent 2 realtors to my home saying I had 2 much equity. Anyway I feel like doing voluntary dismissal. Selling my home getting all my money. And getting a place under my daughters name or just settling the debts myself.

    I have to disagree with his opinion on chapter 13. My monthly payments were 20% of what I was paying on credit cards and such. If you are disciplined and don't overspend it's a great option. Especially with our current economy in the US.

    I am in the last year and it can be done. Was it worth it? I don't know, if you can you should pay everybody back what is owed. Again, if you can. If you are just using the system, it doesn't matter what you do. What comes around goes around.

    My servicer is putting the wrong year on my payments they're manipulating my payments and trying to say I haven't paid anything on the past due balance from my forbearance also the amount that they had me to resume paying my my ex servicer Wells Fargo when I did my bankruptcy they didn't lower the amount the $58,000 that was supposed to be exempt and I'm still paying taxes on all of it too

    Well I did a bankruptcy chapter 7 in 2017 nobody told me I had to reaffir my mortgage and I told the lawyer specifically I didn't want my mortgage on there cuz I only owed 85,000 and I want to keep in good standing with them. So what they didn't tell me either was that they weren't going to report my payments so for the past 7 years 8 years they never reported that I made making all my payments on time and they have a little calendar there underneath the it was Wells Fargo they have a little calendar underneath saying that you know that states that it's checked off when I paid and not checked off when I didn't pay so it wasn't checked off since 2017 when I file my bankruptcy when I filed. When I filed my bankruptcy I was on time and paying regularly so it's it's saying that I've never paid my mortgage again in the past 8 years in other words so I called Wells Fargo and I asked him to correct it and they wouldn't and and I was wondering why I couldn't get a car credit card I couldn't get a loan I couldn't get any anything and I was treating treated terribly whenever I called Wells Fargo and stuff you know like I wasn't paying my bills and I would and Wells Fargo what what they don't tell you also is that when you sign a mortgage that promissory note that you sign has a value to it. So the mortgage company turns you know turns that promissory note into cash cuz they can sell it and then they lend you the cash that they made off of your promissory note and they charge you interest they didn't tell you that either so in other words it's like you're giving them $250,000 and then they're giving you a $250,000 back with with interest included that you have to pay Tell me do you think I would give them $250,000 for free and take a loan out and pay interest on it hell no so that wasn't just closed to me they've been totally deceiving and dishonest you know and they did not tell me they were going to sell my note without my mortgage first of all and there are other names as being on my property on the register from the D's cuz I went online to look up my deed and they were all these other names for the first 10 years that I own the house like they owned it or lived here and I don't know any of these names so that was strange that's when I figured out they probably sold the note over and over a few times and I'm on disability I'm very sick I've been very sick since COVID I got a disease while being sick on clover three times so that's why I took two forbearances The first time they put the they did it deferral put on the back which was great and then they sold me while on forbearance to another company and they deceived me they said they were sending me to their servicing department they didn't tell me they were selling me all together so I was surprised when I got a letter saying welcome here's your account and we're selling you you know and I got sold August 1st now I was still on forbearance. So I came off of forbearance on September 30th in the meantime the new servicer sent me three letters on August 15th and the last one said they're a debt collector so they were harassing me through the through regular hard male hard copy males snail mail. Also they're counting my mortgage from before my bankruptcy of what I originally had for mortgage and they didn't take nobody took the $58,000 off of my balance which was supposed to be exempt if I'm interpreting that correctly. So when I came up for forbearance I found out I got a claim a proof of claim or something in the mail and that's how I found out that my new servicer was on chapter 11 on September 22nd they filed chapter 11 we organization or whatever and my and they still continue to harass me. I started paying August I mean October 1st of 24 when I came back from forbearance and I've been paying for 7 months and they sent me a statement saying I'm behind that I haven't paid since 2023 February what are you talking about I've been paying for 7 months? Then when I started paying in October of 23 they dated it as October 22 and then they they're dating my payments from a year ago and I don't understand I don't know what to do. They want the $9,000 I fell behind on from forbearance also and they didn't even have deferral on their option which is a new policy from Freddie Mac that they have to offer to pearls now so they they wanted to do a short sale right off the bat they didn't want to cooperate with me they didn't want me to pay extra they didn't want to make any kind of other arrangement that's when I called Freddie Mac Freddie Mac set up a modification but they wanted me to put the deferred amount on the in the modification so they can collect interest on it so I refused so now they're saying if I don't fill out another application for assistance then they're going to start foreclosure over $9,000 and my balance according to everybody is 90,000 on my mortgage all together My house is worth 300,000 and because they put discharged no because well they won't give me any I can't get credit I can't get a credit card I can't get you know a HELOC loan even they wouldn't give me a loan off of my equity and so everything looks like I'm really bad and I'm not I'm really good I always paid. I don't know what to do I'm at wits send. So I got in touch with TransUnion and I told him that I've been paying for the last 8 years and they said they would accept hard copies of proof so I sent it to them because Wells Fargo wouldn't update it they said they couldn't so I sent them all the hard copies of all my payments for 7 years I had to print all that out and they threw it away and they took my Wells Fargo right off of the record so it's like I never even had a mortgage with them then Equifax and Experian wouldn't do anything they kept it on they're still keeping it on even though I showed them prove I told him that TransUnion took it off and everything they're still reporting it and I don't know that's crazy too there's more that doesn't have to do with the mortgage but like a credit company Midland said I owe them all this money I never even had a contract with midland they were collecting for Capital One or something so we took it to court and the judge totally dismissed it and said I don't owe anything he wrote it right on his judgment Bonnie you don't owe anything you don't have to pay this well Midland put it on my credit report and I I sent them a copy of the of the order from the judge and everything and they still kept it on there all three credit unions credit bureaus

    My Dad had Alzheimer's and Dementia. A Half Sister had full POA. Then She and Her Husband Declared Bankruptcy. Dad passed away . They landed nicely with a half million dollar Condo they built while under Chaoter 7. And a New BMW. Now they just say Dad was Broke when He died and went no contact. Nothing I can do about it. I finally got a DES Investigstor on it. That's underway now. Nothing will happen. Crime pays if it's paper shuffling Crime! There is a Trust but they just say there isn't.. they robbed Mom and I. I you can't afford to hire an attorney and are in another state barely getting by. Just suck it up and try to forget it. 😢

      Bankruptcy may stop an eviction temporarily but the Bankruptcy Code is friendlier to landlords than tenants in eviction cases.

      I think there has to be a balance. Bankruptcy is a last resort and a big step and it has long term repercussions. On the other hand, struggling with debt you can never pay for decades, never being able to save for retirement is not a good option.

      Many times, you can lower the interest rate in a Chapter 13. It depends on how new the debt is.

    My vehicle was repoed jan 4th after my Cu was merged eith another CU i was never notified of the merger or as a shareholder jever h8ven a bite i was in the m8dfle of a refinance with my CU and the bajk mgr died who had me on a skip pay till the refi and a investigation finished on a employee that added my ex mother in law on my account that i didnt authorize it wasnt a joint account 24,500 abd i have the EMAIL from my bank CEO they were doing a NACU claim to get me hack the 24,500 but his passing screwed th8ngs up then not ever getting mitification and the new CU lieing about not having my address i have all the proof that shows all this. I have yet to get a 10 day letter. They damagedcthe drive way lied about what time they took my truck. And made threats after i objected to the repo and by law they cant take the behicle after the consumer objects and the threat are a breech if peace. I even told them take the halace if the vehicle put of the 24,500 + intretest they owe me on the interest ive lost which totals 31,728 + attorney fees and late fees they owe me due to my ex and her mom taking all that money without ever being authorized on my account.

    This was a 'wow' video, it really was. I am very familiar with bankruptcy cases, I used to help people file them. Never would have thought that these facts were true, just mind-blowing. The trustee gets just $60 or a no-asset case? They can get big bucks out of cases with assets? I had a totally different view of trustees, thanks for your insight into this.

    Do you know how likely Citibank and Nordstrom are to take some sort of settlement? And if I go the bankruptcy route will they force asset liquidation. I own a house with with my siblings but want to avoid a lien or anything like that. Thanks.

      I have settled debts with many creditors. If the creditor (or collection agency) sees little chance of collecting using the court system they will be more inclined to agree to a settlement. Cash is always king in these negotiations.

    Does is vary by State (Florida) and what if the Lender repurchase the home. Is there any room for negotiation?

    In 2017 Lawyer that discharged ne from house loan. Lawyer didnt inform me about reafirming loan. I was up to date with loan I didn't fall behind and I didn't want the house note, loan,discharged. The lawyer I had was a low-budget lawyer for low-income people and was pretty much almost free, insisted that I didn't want the note for the housedis loan before filing the bankruptcy chapter 7. Summit Bank never reported any of my payments while I paid the full interest property taxes and to print on the principal of the home for 6 years and nothing was recorded on TransUnion to say that I made the payments.. Well I was on forbearance in August of 2023 and I got off in September 30th 2023 and while I was on forbearance on August 1st my company sold me to another servicer. Nearest services started harassing me the second week of August and I still was convenience.

    Hello i have a question: i filed chap 13 i have insurance as they requested (i didnt know if i was getting the car back so i didnt continue payments) so i restarted my insurance made my first chap 13 payment the bank is still fighting this. It doesn't feel right that court is next month which means i have been making my chap13 payments plus insurance but the car is still not in my possession. No one can tell me how this is ok to do

    What if I only make $3000 a month and my bills are $6000 a month can I pay each creditor $2 a month?
